Welcome to Danz. This Privacy Policy explains how Danz (“we,” “us,” or “our”) collects, uses, stores, shares, and protects information when you use the Danz website, mobile application, and related services (collectively, the “Services”).

By using the Services, you acknowledge that you have read and understood this Privacy Policy.

1. Information We Collect

We may collect the following categories of information:

1.1 Information You Provide

  1. account information, such as email address, nickname, and login details;
  2. payment and subscription information processed by third-party payment providers;
  3. content you upload or submit, such as images, videos, text, prompts, and feedback;
  4. information you provide when you contact us.

1.2 Information Collected Automatically

  1. device information, such as device model, operating system, language, and app version;
  2. log and usage information, such as access times, feature usage, crash data, and IP address;
  3. identifiers, such as device identifiers and advertising identifiers, where applicable.

1.3 Information from Third Parties

If you log in through a third-party account or use app store, analytics, or payment services, we may receive necessary information from those third parties.

1.4 Face Data

If you choose to upload a photo, video, or other image containing a face in order to use face-related features of the Services, we may collect and process face data contained in that content. Face data may include:

  1. facial images appearing in uploaded photos or videos;
  2. facial landmarks, face position, orientation, and related technical information necessary to detect, align, track, or process a face in order to generate the requested output;
  3. AI-processed face features derived from uploaded content solely for providing the face-related function you request.

We do not collect face data from your device in the background, and we only process face data when you actively choose to upload content and give consent for such processing.

We do not use face data to identify you personally, create a face recognition database, verify identity, authenticate users, or profile users across different services.

2. How We Use Information

We may use the information we collect to:

  1. provide, operate, and maintain the Services;
  2. process logins, account management, subscriptions, and payments;
  3. generate, process, and deliver AI content;
  4. improve product features, performance, and user experience;
  5. detect security issues, prevent fraud, troubleshoot errors, and ensure compliance;
  6. respond to your inquiries, feedback, and complaints; and
  7. send service-related notices, updates, or marketing communications where permitted by law.

2.1 How We Use Face Data

We use face data only for the limited purpose of providing the specific feature requested by you, such as:

  1. detecting and locating a face in uploaded content;
  2. aligning, tracking, analyzing, or transforming facial areas necessary to generate dance, animation, stylized, or other AI-based output requested by you;
  3. returning the processed output to you within the Services; and
  4. maintaining service security, preventing abuse, and troubleshooting the relevant feature.

We do not use face data for advertising, marketing, user profiling, or training a facial recognition system.

3. Uploaded Content, Face Data, and AI Processing

To provide the Services, images, videos, text, prompts, face data contained in uploaded content, and other content you upload may be transmitted to our servers or to third-party service providers that help us provide cloud storage, content processing, or AI generation functions.

If your uploaded content contains a face, the app will present a notice and request your permission before face data is transmitted for processing by a third-party AI or technical service provider, where required.

Please do not upload content you do not have the right to use, or content containing sensitive personal information, unless you have a lawful basis and authorization to do so.

4. How We Share Information

We do not sell your personal information. We do not sell or rent face data.

However, we may share information:

  1. with third-party vendors providing cloud hosting, payments, analytics, customer support, security, or AI capabilities;
  2. as necessary to complete a feature, request, or transaction you initiate;
  3. to comply with applicable law, legal process, court orders, or government requests;
  4. to protect our rights, safety, property, and those of our users or the public; or
  5. in connection with a merger, acquisition, asset sale, financing, or similar corporate transaction.

4.1 Third-Party AI and Service Providers

In order to provide certain AI functions, we may transmit user content, including photos, videos, prompts, and face data contained in uploaded content, to third-party service providers acting on our behalf. These providers may include:

  1. cloud infrastructure and storage providers;
  2. AI model or media processing service providers;
  3. content moderation, security, or technical support providers.

We require such service providers to process personal data only for the purpose of providing services to us, and to provide the same or a substantially similar level of privacy and security protection as required by applicable law.

Where applicable, we will identify the relevant third-party service provider in the in-app consent notice or other just-in-time disclosure before transmitting personal data.

4.2 AI Service Providers

To provide AI-powered features, we may transmit user-submitted prompts and uploaded content, including images, audio, videos, and face data contained in uploaded content, through our self-hosted backend to the following third-party AI service providers:

  1. Microsoft Azure OpenAI Service, which we use to support AI-powered processing; and
  2. Kling AI, which we use to support AI video generation.

These providers process such data solely on our behalf and only for the purpose of providing the feature requested by the user. Where required, the app presents a clear in-app notice and obtains the user’s consent before such data is transmitted for processing.

5. Data Retention

We retain information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

5.1 Retention of Uploaded Content and Face Data

Face data contained in uploaded content, and any face features or technical face data derived from such content, are retained only for as long as reasonably necessary to provide the requested feature, generate the requested output, maintain security, comply with legal obligations, resolve disputes, and enforce our agreements.

Unless a longer retention period is required by law or necessary for security or dispute resolution:

  1. uploaded photos/videos and related face data will be deleted or de-identified after processing is completed or within a reasonable retention period;
  2. temporary technical face data generated during processing will be deleted as soon as it is no longer needed for the processing purpose;
  3. if you delete relevant content or request deletion where applicable, we will delete or de-identify it within a reasonable period, subject to legal and technical limitations.

6. Data Security

We use reasonable technical and organizational measures to protect your information, including face data, but no method of transmission or storage is completely secure. Please keep your account credentials safe.

7. Your Rights

Depending on your location and applicable law, you may have rights to:

  1. access, correct, or delete your personal information;
  2. object to or restrict certain processing;
  3. withdraw consent;
  4. request a copy of your data; and
  5. opt out of marketing communications.

You may contact us using the details below to exercise your rights, and we will respond as required by applicable law.

If we rely on your consent to process face data, you may withdraw that consent at any time. Withdrawal of consent will not affect processing already completed before withdrawal, but it may prevent us from providing face-related features.

8. Children

The Services are not intended for children below the legal age in their jurisdiction without parental or guardian consent. If we become aware that we have collected personal information from a child without appropriate authorization, we will take reasonable steps to delete such information.

9. International Transfers

Because we or our service providers may process information in different countries or regions, your information may be transferred to and stored outside your jurisdiction.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted within the Services or otherwise communicated to you. Your continued use of the Services after the updated policy becomes effective means you accept the revised Privacy Policy.
